LUXELLE EVENTS LTD EQUIPMENT HIRE AGREEMENT
This Equipment Hire Agreement (“Agreement”) is entered into by and between:

and
The Hirer, being the person or entity hiring equipment, whose details are provided through the booking form on our official website.
This agreement outlines the terms and conditions governing the hire of equipment from Luxelle Events Ltd. By proceeding with the booking, the hirer agrees to comply with all terms and conditions set forth herein.

DEFINITIONS
1.1 “Equipment” refers to any items, products, or goods hired from Luxelle Events Ltd, as specified in the booking confirmation.
1.2 “Hire Period” means the agreed duration of hire, as outlined in the booking confirmation email.
1.3 “Premises” refers to the delivery location specified by the Hirer during the booking process.
1.4 “Hire Fee” means the total amount payable by the Hirer for the hire of the equipment, inclusive of VAT at the prevailing rate.

BOOKING AND PAYMENT
2.1 Booking Process:
- All bookings must be made exclusively through our official website.
- A booking confirmation will be sent to the Hirer via email upon successful submission of the booking form.
- Equipment availability is subject to confirmation by the company.
2.2 Payment Terms:
- A 20% deposit of the total hire fee is required to secure the booking.
- The full payment of the hire fee must be made no later than 7 days prior to the hire date.
- A security deposit equivalent to 20% of the total hire value is required and must be paid alongside the full hire fee.
- All prices quoted include VAT at the current applicable rate.
2.3 Security Deposit:
- The security deposit is refundable within 7 working days after the equipment is returned, provided no damage, loss, or breach of this Agreement has occurred.
- Deductions may be made from the security deposit to cover:
- Repair costs for damaged equipment.
- Replacement costs for lost or irreparable items.
- Any breach of the terms and conditions outlined in this Agreement.
- In cases of significant damage or breach, the Company reserves the right to retain the full security deposit.

DELIVERY AND COLLECTION
3.1 Delivery Service:
- Delivery charges are calculated based on the delivery location and the quantity of equipment hired.
- Specific delivery time slots must be agreed upon in advance between the Hirer and the Company.
- The Hirer must provide clear access requirements and ensure the delivery location is safe and accessible.
- The Hirer, or an authorized representative, must be present at the delivery location to receive the equipment.
3.2 Collection Service:
- The Hirer must ensure that all equipment is ready for collection at the agreed time and location.
- Equipment must be returned in the same condition as it was delivered, with all components intact.
- Additional charges may apply if the equipment is not ready for collection at the agreed time.
- The Company reserves the right to charge for any cleaning, repair, or replacement required if the equipment is returned in a condition different from its original state.

HIRER’S OBLIGATIONS
4.1 Care of Equipment:
The Hirer agrees to:
- Use the equipment safely and only for its intended purpose.
- Keep the equipment secure and protected from damage, theft, or adverse weather conditions.
- Not modify, alter, or attempt to repair the equipment without prior written consent from the Company.
- Report any issues, damages, or malfunctions to the Company immediately.
- Follow all usage instructions and safety guidelines provided by the Company.
4.2 Site Requirements:
The Hirer must:
- Ensure there is adequate space at the premises for the equipment to be safely delivered, installed, and used.
- Provide safe and unobstructed access for delivery and collection.
- Maintain suitable environmental conditions for the equipment during the Hire Period.
- Comply with all relevant safety regulations and guidelines.
4.3 Prohibited Actions:
The Hirer must not:
- Sublease or lend the equipment to any third party.
- Relocate the equipment to a different location without prior written consent from the company.
- Use the equipment beyond the agreed hire period without prior approval.
- Engage in any unauthorized modifications or alterations to the equipment.

DAMAGES AND LIABILITY
5.1 Equipment Damage:
- A full inspection of the equipment will be conducted at the time of delivery and collection.
- Photographic evidence of the equipment’s condition will be maintained by the Company.
- The Hirer will be liable for the cost of repairs for any damage caused during the Hire Period.
- If the equipment is deemed irreparable, the Hirer will be charged the full replacement cost.
5.2 Insurance:
- The Company’s insurance covers standard risks associated with the equipment.
- The Hirer will be responsible for any excess charges arising from claims.
- The Hirer is advised to obtain additional insurance to cover any risks not included in the Company’s policy.
- The Company may request proof of the Hirer’s insurance coverage before confirming the booking.

CANCELLATION POLICY
6.1 Cancellation Charges:
- 30+ days before the hire date: Full refund minus a 10% administrative fee.
- 15-29 days before the hire date: 50% of the total hire fee will be refunded.
- 8-14 days before the hire date: 25% of the total hire fee will be refunded.
- 0-7 days before the hire date: No refund will be issued.
6.2 Modifications:
- Requests to modify the booking (e.g., change of date) are subject to availability.
- An administrative fee will apply to all modifications.
- A minimum of 14 days’ notice is required for any changes.
- Price adjustments may apply if the modification affects the scope of the booking.

HEALTH AND SAFETY
7.1 Safety Measures:
- All equipment is supplied in a safe and functional condition.
- Usage instructions and safety guidelines will be provided to the Hirer.
- Risk assessments are available upon request.
7.2 Accidents and Incidents:
- Any accidents, incidents, or injuries involving the equipment must be reported to the company immediately.
- The company will provide an emergency contact number for urgent matters.
- An investigation process will be initiated, and the hirer may be required to provide documentation or statements.

TERMINATION
The Company reserves the right to terminate this agreement immediately if:
- The Hirer breaches any terms or conditions outlined in this agreement.
- Payment terms are not met.
- Safety concerns arise regarding the use of the equipment.
- The Hirer provides false or misleading information during the booking process.

GENERAL CONDITIONS
9.1 Force Majeure:
The Company will not be held liable for any failure to fulfill its obligations due to events beyond its reasonable control, including but not limited to:
- Severe weather conditions.
- National emergencies.
- Transport disruptions.
9.2 Data Protection:
- The Hirer’s personal data will be processed in accordance with GDPR regulations.
- Data will only be used for the purpose of fulfilling the hire agreement.
- The Company’s privacy policy applies, and security measures are in place to protect personal information.

DISPUTE RESOLUTION
10.1 Resolution Process:
- Complaints must be submitted in writing to the Company.
- The Company will respond within 14 days of receiving the complaint.
- Mediation services may be offered to resolve disputes.
- This agreement is governed by the laws of England and Wales.
- ACCEPTANCE OF TERMS
By proceeding with the booking, the Hirer acknowledges and agrees to:
- Full understanding of all terms and conditions outlined in this agreement.
- Acceptance of all responsibilities and obligations.
- Consent to the processing of personal data in accordance with GDPR.
